Under Florida law, adoption permanently transfers all legal parental rights and responsibilities from the birth parent(s) to the adoptive parent(s). After the adoption is finalized, the child is considered, under the law, to be the legal child of the adoptive parent, with all the same rights as a biological child—including inheritance and custody.
There are several types of adoptions recognized in Florida:
Stepparent Adoption: A spouse legally adopts their partner’s biological child. This is the most common type of adoption and is typically more streamlined when the biological parent consents.
Relative Adoption: Grandparents, aunts, uncles, or other family members assume legal parental rights. This is often necessary in situations where the biological parents are unable to care for the child.

While every adoption is different, most cases in Florida involve the following key steps:

Consent: In most cases, the biological parent(s) must consent to the adoption, unless their rights are involuntarily terminated due to abandonment, neglect, or unfitness.
Home Study: Non-relative adoptions usually require a formal home study conducted by a licensed professional to assess the safety and suitability of the adoptive home.
Background Checks: Prospective adoptive parents must complete background screening and fingerprinting to ensure child safety.
Filing the Petition for Adoption: A formal petition is filed with the court, detailing the relationship, purpose, and intent of the adoption.
Final Hearing: A judge will review the case and, if all legal criteria are met, will finalize the adoption—making it official and permanent.
